The Clients Challenge
The client’s partner had recently died and had appointed her the executor of his will. Like most people who have never dealt with a probate situation before, the client needed much guidance.
The TM Law Solution
TM Law was happy to help the client and started off by gathering all the financial information and documentation relating to the deceased from his partner. Most importantly, TM Law collected the original will – without which it would have been impossible to apply for a grant of probate.
TM Law submitted an application for a grant of probate (which is now an online process) and, less than two weeks later, received the grant of probate as well as a number of copies of this.
The grant of probate entitled TM Law to pay off the debts of the deceased and to apply to the financial institutions that were holding money owed to the deceased’s estate for the payment out of those monies.
Once the money was received from banks and other financial institutions, TM Law paid off the remaining small debts, including repayment of pension payments which had been over paid, and then prepared a summary of all money in and money out.
Finally, TM Law was able to pay the beneficiaries who had been bequeathed money by the deceased and then the remaining money (the Residuary) was paid out to the deceased’s partner. At this stage, the estate was concluded.
