A partial U-turn on controversial plans to scrap legal aid for all clinical negligence cases was announced by the Government this week.
The Ministry of Justice said it will table an amendment to the Legal Aid, Sentencing and Punishment of Offenders (LASPO) Bill to retain legal aid ‘in obstetrics cases which result in severe disability’.
Babies up to eight weeks old who have suffered neurological injuries as a result of clinical negligence would remain entitled to legal aid.
APIL has frequently cited brain damaged babies among those who will be the hardest hit by the LASPO Bill plans.
